Venue Applicable Law. This site is created and controlled by Giraffe Design in the United Kingdom. As such, the laws of England and Wales will govern the terms and conditions contained in this Agreement and elsewhere throughout the Site, without giving effect to any principles of conflicts of laws.
Lapsed Accounts In order to keep Giraffe Design membership current, if a member does not access his or her account for a period of 180 days or more, Giraffe Design may, in its sole discretion, terminate such member's account. Giraffe Design will endeavor to notify a member of Giraffe Design intent to terminate such member's account. If the Member fails to respond to such email notice with 7 days after the day it is sent by Giraffe Design, such member's account will be terminated as noted above. Giraffe Design strongly recommends that all members keep their accounts and contact data current. Giraffe Design has no obligation to maintain accounts that appear to Giraffe Design to have been abandoned.
Verify Members' Address Giraffe Design reserves the right to contact a Member via email to verify the accuracy of account information (including the Member's correct name and address) that is needed to provide the Member with the information he or she requested from Giraffe Design.
Website Test Area Giraffe Design will upload website projects to our test area for purpose of checking by our clients.
Website Approval Giraffe Design will require confirmation by email that our clients/members have thoroughly checked their website, only then will Giraffe Design make the website live.
Hosting Giraffe Design offers full hosting services (provided by a third party). Giraffe Design is NOT responsible for the operational efficiency of this third party hosting service. Nor can we be held responsible for any losses incurred due to ‘down time’ by third party hosting servers, or loss of data due to virus impregnation of third party hosting servers or losses due to faulty back-up systems that are the responsibility of the client. Giraffe Design will retain the project on its archive system. Giraffe Design hosting provider aims to deliver 99.99% server connectivity. 99.9% uptime guarantee does not include scheduled maintenance - normally conducted outside of working hours. Any connectivity downtime will affect your email (if POP and SMTP are provided by Giraffe Design). Any downtime is outside of the control of Giraffe Design.
Refunds Policy Refunds are discretionary unless stated otherwise in our terms of business. All requests for a refund will be considered on their merits and so you submit all relevant information and copies of correspondence and other documents when making your request.
